Maybe you should use link instead of url
$this->Html->link( string $title, mixed $url = null, array $options = array(), string $confirmMessage = false);

$this->Html->link('title', '/photos/upload?PHPSESSID=' . session_id() . '&privacy=' . $_GET['privacy'], array('escape' => false));

This should resolve your problem.
